P&H: 2.32 Kg Heroin involving Commercial quantity Grants Bail In NDPS Case

The Punjab and Haryana High Court has granted regular bail in an NDPS case involving alleged recovery of 2.32 kg heroin, citing prolonged pre-trial incarceration and delay in trial as grounds to dilute the rigours of Section 37 of the NDPS Act in light of Article 21. 

The case stems from an FIR at Police Station Amritsar (Rural), under Sections 21, 29, 61 and 85 of the NDPS Act. As per the FIR, BSF personnel intercepted the petitioner and a co-accused near border fencing. The co-accused was apprehended and heroin allegedly recovered from the fields.
