P&H: Anticipatory bail cannot be denied on the ground that recovery has not been effected from accused

The Punjab and Haryana High Court has made absolute the interim anticipatory bail granted to Megh Parkash alias Megh Prakash in an FIR registered under Section 318(4) of the Bharatiya Nyaya Sanhita, 2023.

The case arose from allegations that the petitioner, director of M/s Megh MediTech Private Limited, had taken ₹55,50,000 from a doctor running a superspecialty hospital in Bathinda for supplying surgical equipment and machines, but later failed to deliver them. The complainant claimed that the petitioner kept postponing the matter and eventually refused to supply the ordered machines.

The petitioner, however, argued that the dispute was purely commercial....
