P&H: Upholds 58 Year Retirement Age for Earth Work Mistry Group C, Dismisses Writ Petition
The Punjab and Haryana High Court has dismissed a writ petition filed by Taranjit Sharma, who had challenged an order treating his retirement age as 58 years on the ground that he should have been considered a Group D employee.
Justice Sudeepthi Sharma noted that Sharma was appointed as a Painter and later as an Earth Work Mistry, and that the post carried a grade pay of Rs.1900. Under the Punjab Government’s classification issued after the Fifth Pay Commission, posts with grade pay from Rs.1900 to Rs.3799 fall in Group C.
