P&H: grants Anticipatory Bail in NDPS Case Involving Commercial Quantity of Ganja as custodial interrogation is not required
The Punjab and Haryana High Court has refused to grant anticipatory bail to Surender Singh in a case registered under the NDPS Act at Sirsa City police station.
The petition was filed under Section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023, seeking pre-arrest bail in FIR No. 330 dated 24.06.2026. The case arose from allegations under Section 20(b) of the NDPS Act.
According to the court record, the police claimed recovery of 1 kg 500 grams of ganja from the petitioner. Since the quantity recovered was commercial in nature, the stricter bail conditions under Section 37 of the NDPS Act became applicable.
