P&H:rejects deduction of widow’s family pension in motor accident compensation case, enhances consortium for all five dependants
The Punjab and Haryana High Court has partly allowed cross appeals arising out of a fatal motor accident claim, while refusing to deduct the widow’s family pension from the compensation payable under the Motor Vehicles Act, 1988.
The case arose from the death of Gurmit Singh in a road accident on 10 August 2020. His legal heirs, including his widow, two children and parents, sought compensation for his death. The Tribunal had awarded ₹73,29,175, taking into account his Army pension, salary from Haryana Police, future prospects, personal expenses and conventional heads, including consortium only to the widow.
