P&H: Proclamation not published in accordance with law quashed
The Punjab and Haryana High Court has set aside an order declaring a man a proclaimed person in a criminal case, after finding that the mandatory procedure for publication of proclamation was not followed.
The petition was filed by Neeraj Sharma under Section 528 of the BNSS, 2023, challenging the order of the Additional Chief Judicial Magistrate, Karnal, dated 13 September 2023. The order had declared him a proclaimed person in a case arising out of FIR No. 458 of 2018, registered under Section 160 of the IPC, corresponding to Section 194(2) of the BNS.
