P&H: Dismisses second appeal in land dispute over Verma Nursing Home, says no substantial question of law arises

The Punjab and Haryana High Court has dismissed a second appeal filed by Ramwati and others in a property dispute concerning land allegedly encroached upon by Verma Nursing Home in Bhiwani. Justice Deepak Gupta upheld the concurrent findings of the trial court and the first appellate court, which had rejected the plaintiffs’ claim for declaration, possession and injunction.

The plaintiffs had claimed ownership over land measuring 9 kanal 11 marla, saying they were successors of Har Swaroop. They alleged that defendant no. 2 had encroached upon a portion of the land and sought recovery of possession along with consequential relief....
